An at-fault accident in Oregon is a car accident caused by a negligent or careless driver. Oregon is an at-fault state, which means the at-fault driver’s liability insurance covers medical expenses and property damage for other drivers and their passengers involved in an accident.
Every state has different liability insurance requirements. In Oregon you are legally required to have at least $25,000 of bodily injury coverage per person, $50,000 of bodily injury coverage per accident, and $20,000 of property damage coverage.
How Oregon Determines Negligence
States assign fault based on slightly different definitions of negligence. Oregon uses modified comparative negligence, meaning that drivers do not recoup accident-related costs if they are more than 50% at fault for an accident.
For example, if you are 52% responsible for an accident you would not receive any payment because you would be over the 50% threshold.
